Consultant for the Kahnawà:ke Environmental Legislation Project

TIMEFRAME: September 2021 to March 2022.

WORK ARRANGEMENT: Remote with some in-person meetings if required.

BUDGET: Maximum limit for the project is $55,000. Final contract amount is dependent on selected consultant’s level of expertise, relevant experience, and time commitment.

EXPERTISE AND EXPERIENCE: Legal background, especially environmental law, experience, and in-depth understanding of the jurisdictional context of Indigenous communities in Canada.

BACKGROUND: The Kahnawà:ke Mohawk Territory is located on the south shore of the St. Lawrence River across from the island of Montreal. Environmental damages over the last few decades have demonstrated that environmental legislation is required to ensure the protection of the environment for current and future generations. Existing environmental legislation in Kahnawà:ke is outdated and inadequate to provide environmental protection for the long-term.

OBJECTIVES: The objectives of the Environmental Legislation Project are to assess existing legislation, identify needs, gaps, overlaps, and risks, and develop an Environmental Legislative Framework that will serve as the roadmap for the development of effective and culturally-appropriate environmental legislation in Kahnawà:ke.

SCOPE SUMMARY: The work should be accomplished through research, meetings and interviews with stakeholders, review of existing environmental legislation and approaches in Kahnawà:ke and other Indigenous communities as well as other jurisdictions, and review of other relevant documentation. A report will be prepared presenting the research results, identifying legislation gaps, needs, and risks, as well as options and recommendations. Short-term, medium-term, and long-term solutions should be elaborated to encompass the Environmental Legislative Framework.
